Special Master/Consent Monitor from Employment Litigation

• The use of ADR processes have become a major part of class action/mass claims litigation. Across the federal and state legal system, neutrals are being appointed by the court as Mediators or Special Masters, and are being selected by the litigants as Mediators, Arbitrators, Consent Monitors, or Liability Design Consultants. ADR has become a major tool in settling class action litigation.

Resolution of NASD Litigation

• Richard Fincher is an established mediator and arbitrator of NASD related litigation. Since 2003, he has been selected by the parties for over ten matters concerning employment or suitability claims for over $500,000. He has served as Chair of the Arbitration Panel for seven of the matters. The range of the employment claims include general breach of contract, non-compete disputes, wrongful discharge, RICO, non-solicitation disputes, and constructive discharge.

• In 2007, Richard Fincher sucessfully completed coursework as Panel Chairman and sucessfully completed coursework on the new Code of Arbitration.
